Resumo

O surgimento e a crescente importância das estruturas jurídicas transnacionais privadas na governança global apresentam um enigma para a teoria jurídica. Essas novas formas de direito transnacional (DT) podem ser encontradas em diversas áreas, desde questões relacionadas ao comércio até responsabilidade corporativa, direitos humanos e trabalhistas, e proteção ambiental. Os constitucionalistas transnacionais têm argumentado que esse fenômeno possui uma qualidade constitucional. O desafio do constitucionalismo transnacional está em desenvolver um modelo institucional que explique como a autoridade jurídica constitucionalmente embutida pode surgir independentemente das estruturas institucionais do direito público baseado no Estado. Neste artigo, propomos uma nova estrutura teórica para pensar sobre a autoridade jurídica não-estatal, que chamamos de “constitucionalismo em rede”. Conceituamos a autoridade jurídica transnacional como um fenômeno emergente, baseado em rede, e elaboramos as condições institucionais que sustentam seu surgimento. Ilustramos nossa tese por meio de uma análise de rede de uma grande amostra de códigos de responsabilidade social corporativa.

Biografia do Autor

Oren Perez, Faculty of Law Bar-Ilan University

Senior lecturer at the faculty of law, Bar-Ilan University, Israel. He wrote his doctoral dissertation at the London School of Economics and Political Science (1997-2000) and won the Marie Curie Fellowship. His main fields of interest are environmental law, international economic law and legal theory.

Ofir Stegmann, Faculty of Law Bar-Ilan University

A Ph.D. student at Bar-Ilan University Faculty of Law and a member of the BIU LawData Lab. His doctoral dissertation, “Regulatory Networks: Empirical Network Analysis of CSR International Organizations and the Israeli Legislators and Parties” (advisors: Prof. Oren Perez & Prof. Reuven Cohen), integrates regulatory questions with network science and big-data programming implementations. During the doctoral studies, was awarded by the President of Israel, Bar-Ilan President and Bar-Ilan Rector, and assists\ed in courses on data science, networks, text analysis and international economic law. Has a LL.B. (Summa Cum Laude) from Bar-Ilan University and clerked for Adv. Eli Zohar, the chairman of Goldfarb-Seligman law firm.
