DIREITO À EDUCAÇÃO SUPERIOR: O PAPEL DO ESTADO NA GARANTIA DA EXPANSÃO COM QUALIDADE

O artigo expõe os fundamentos jurídicos da ideia de educação como um direito, na esfera internacional e no ordenamento brasileiro. A partir desses parâmetros, busca os fundamentos para a discussão sobre o direito à educação superior. Analisa o processo de expansão da educação superior, os movimentos que alteraram as estruturas dos sistemas de elite, que passaram a ser caracterizados, em boa parte, como sistemas de massas. Aborda também o papel da educação superior para o desenvolvimento, seus benefícios econômicos e não econômicos. Por fim, destaca a importância da qualidade para a concretização dos benefícios da educação superior e a responsabilidade do Estado pela sua garantia, por meio de uma política regulatória que tenha como fundamento e objetivo a concretização das políticas públicas e dos direitos fundamentais.
